Article 7 [Personal Jurisdiction] A crime defined in this Law committed by a citizen of the People's Republic of China outside the territory of the People's Republic of China shall be governed by this Law; provided, however, that criminal penalty may be exempted if the maximum term of sentence stipulated in this Law is not more than three years.
A crime defined in this Law committed by a State functionary or serviceman outside the territory of the People's Republic of China shall be governed by this Law.
