Article 8 [Protective Jurisdiction] Where a crime is committed by a foreigner against the State or a citizen of the People's Republic of China outside the territory of the People's Republic of China, and the minimum term of sentence stipulated in this Law is more than three years, it may be governed by this Law, unless it is exempted from criminal penalty according to the law of the place where the crime is committed.
