Article 151 [Smuggling Weapons, Ammunition, Nuclear Materials, Counterfeit Currency, Cultural Relics, Precious Metals, Precious Animals, Precious Animal Products, or Goods and Articles Prohibited from Import and Export by the State]
A person who smuggles weapons, ammunition, nuclear materials, or counterfeit currency shall be sentenced to imprisonment of not less than seven years and a fine or forfeiture of property, or to life imprisonment and forfeiture of property if the offense is committed under particularly serious circumstances, or to imprisonment of not less than three years but not more than seven years and a fine if the offense is committed under mitigating circumstances.
A person who smuggles cultural relics, gold, silver, or other precious metals, or precious animals or animal products prohibited from import and export by the State, shall be sentenced to imprisonment of not less than five years but not more than ten years and a fine, or to imprisonment of not less than ten years or life imprisonment and forfeiture of property if the offense is committed under particularly serious circumstances, or to imprisonment of not more than five years and a fine if the offense is committed under mitigating circumstances.
A person who smuggles rare plants or plant products or other goods or articles prohibited from import and export by the State shall be sentenced to imprisonment of not more than five years or custody and/or a fine, or to imprisonment of not more than five years and a fine if the offense is committed under serious circumstances.
Where an entity commits any of the offenses stipulated in this Article, and the directly responsible chief and other directly responsible individuals shall be punished in accordance with the provisions of the applicable paragraph of this Article.
