Article 152 [Smuggling Obscene Materials or Wastes] A person who, for the purpose of profit or dissemination, smuggles obscene films, videotapes, audiotapes, pictures, books, periodicals or other obscene materials shall be sentenced to imprisonment of not less than three years but not more than ten years and a fine, or to imprisonment of not less than ten years or life imprisonment and a fine or forfeiture of property if the offense is committed under serious circumstances, or to imprisonment of not more than three years, custody, or supervised release and a fine if the offense is committed under mitigating circumstances.
A person who, evading customs supervision, transports solid, liquid, or gaseous waste from abroad into the territory of China shall be sentenced to imprisonment of not more than five years and/or a fine if the offense is committed under serious circumstances, or to imprisonment of not more than five years and a fine if the offense is committed under particularly serious circumstances.
Where an entity commits any of the offenses stipulated in the previous two paragraphs, the directly responsible chief and other directly responsible individuals shall be punished in accordance with the previous two paragraphs.
