Article 145 [Producing or Selling Substandard Sanitary Equipment] A person who produces or knowingly sells medical devices or medical hygiene materials that do not meet the national or industrial standards for protecting human health shall be sentenced to imprisonment of not more than three years or custody and a fine of not less than fifty percent of but not more than two times the sales amount if the offense is serious enough to endanger human health, or to imprisonment of not less than three years but not more than ten years and a fine of not less than fifty percent of but not more than two times the sales amount if the offense causes serious damage to human health, or to imprisonment of not less than ten years or life imprisonment and a fine of not less than fifty percent of but not more than two times the sales amount or forfeiture of property if the consequences are particularly serious.
