Article 149 [Principles for the Application of Legal Provisions to the Offenses of Producing or Selling Counterfeit or Inferior Goods] A person who produces or sells the products enumerated in Articles 141 to 148 of this Section, which does not constitute the offenses specified in such Articles, shall be convicted and punished in accordance with the provisions of Article 140 of this Section if the sales amount is more than RMB 50,000.
A person who produces or sells the products enumerated in Articles 141 to 148 of this Section, which constitutes the offenses specified in such Articles and the offense stipulated in Article 140 of this Section, shall be convicted of and punished for the most serious offense.
