Article 158 [Falsely Reporting Registered Capital] A person who, when applying for registration of a company, obtains company registration at the company registration authority by submitting false documents or other fraudulent means to falsely report the registered capital, shall be sentenced to imprisonment of not more than three years or custody and/or a fine of not less than one percent but not more than five percent of the falsely reported registered capital if a significant amount of registered capital is falsely reported, serious consequences are caused thereby, or the offense is committed under other serious circumstances.
Where an entity commits any of the offenses stipulated in the preceding paragraph, the entity shall be sentenced to a fine, and the directly responsible chief and other directly responsible individuals shall be sentenced to imprisonment of not more than three years or custody.
