Article 141 [Producing, Selling, or Providing Counterfeit Drugs] A person who produces or sells counterfeit drugs shall be sentenced to imprisonment of not more than three years or custody and a fine, or to imprisonment of not less than three years but not more than ten years and a fine if the offense causes serious damage to human health, or to imprisonment of not less than ten years, life imprisonment, or death and a fine or forfeiture of property if the offense causes death or is committed under other serious circumstances.
A staff member of an entity that uses drugs who knowingly provides counterfeit drugs to others for use shall be punished in accordance with the provisions of the preceding paragraph.
For the purpose of this Law, the term "counterfeit drugs" shall refer to the counterfeit drugs and the drugs and non-drug products that are deemed as counterfeit drugs as defined in the Drug Administration Law of the People's Republic of China.
