Section 1 Producing or Selling Counterfeit or Inferior Goods
Article 140 [Producing or Selling Counterfeit or Inferior Goods] A producer or seller who substitutes counterfeit, inferior, or non-conforming products for genuine, superior, or conforming ones by impurity doping or adulteration, shall be sentenced to imprisonment of not more than two years or custody and/or a fine of not less than fifty percent but not more than two times the sales amount if the sales amount reaches not less than RMB 50,000 but not more than RMB 200,000, or to imprisonment of not less than two years but not more than seven years and a fine of not less than fifty percent but not more than two times the sales amount if the sales amount reaches not less than RMB 200,000 but not more than RMB 500,000, or to imprisonment of not less than seven years and a fine of not less than fifty percent but not more than two times the sales amount if the sales amount reaches not less than RMB 500,000 but not more than RMB 2,000,000, or to imprisonment of not less than fifteen years or life imprisonment and a fine of not less than fifty percent but not more than two times the sales amount or forfeiture of property if the sales amount reaches not less than RMB 2,000,000.
