Article 77 [Revocation of Probation and Execution of Crimes] Where an offender who has been granted probation commits any other crime during term of probation, or it is found, during the term of probation, that the same offender committed any other crime of which they have not been convicted, the probation shall be revoked, they shall be convicted of such other crime or the newly discovered crime, and the punishment to be executed shall be determined based on the penalties imposed in the previous and subsequent judgments in accordance with the provisions of Article 69 of this Law.
Where an offender who has been granted probation violates laws, administrative regulations, or the provisions of the competent authorities of the State Council on the supervision and administration of probation within the term of probation, or violates the prohibition order in the decree of the people's court, under serious circumstances, the probation shall be revoked, and the original sentence shall be executed.
