Article 165 [Illegally Operating Similar Businesses] A director or manager of a State-owned company or enterprise who, taking advantage of their positions, operates, whether independently or with others, businesses similar to those of the company or enterprise by which they are employed, for the purpose of illegal benefits, shall be sentenced to imprisonment of not more than three years or custody and/or a fine if the amount is significant, or to imprisonment of not less than three years but not more than seven years and a fine if the amount is particularly significant.
