Article 128 [Illegally Possessing or Owning Firearms or Ammunition or Illegally Leasing or Lending Firearms] A person who illegally possesses or owns firearms or ammunition in violation of firearm control regulations shall be sentenced to imprisonment of not more than three years, custody, or supervised release, or to imprisonment of not less than three years but not more than seven years if the offense is committed under serious circumstances.
A person who illegally leases or lends their lawfully authorized official firearm shall be punished in accordance with the provisions of the preceding paragraph.
A person who illegally leases or lends their lawfully authorized firearm, causing serious consequences thereby shall be punished in accordance with the provisions of the preceding paragraph.
Where a unit commits the offenses stipulated in the first or second paragraph, the directly responsible chief and other directly responsible persons shall be punished in accordance with the first paragraph.
