Article 65 [General Recidivism] An offender is a recidivist and punishable by aggravated penalties if they commit a crime that shall be sentenced to imprisonment with a term of five years or more or more severe penalties within five years after the completion or pardon of the execution of a prior criminal penalty, except for negligent crimes and crimes committed by offenders under the age of eighteen.
The period of time specified in the preceding paragraph shall be counted from the date of the expiration of the parole period for an offender who has been released on parole.
