Article 134 [Causing a Major Operation Accident, and Forcing Illegal and Risky Operations] A person who, violating the applicable safety management regulations in production or operation, causes a major accident with major casualties or other serious consequences, shall be sentenced to imprisonment of not more than three years or custody, or to imprisonment of not less than three years but not more than seven years if the offense is committed under particularly heinous circumstances. [Forcing or Organizing Others to Engage in Illegal and Risky Operations] A person who forces others to engage in risky operations in violation of regulations, or knowingly organizes operations without eliminating major accident hazards, resulting in major casualties or other serious consequences, shall be sentenced to imprisonment of not more than three years or custody, or to imprisonment of not less than three years but not more than seven years if the offense is committed under particularly heinous circumstances.
Article 134A [Dangerous Operation] A person who, violating the applicable safety management regulations in production or operation, causes a major accident with major casualties or other serious consequences, shall be sentenced to imprisonment of not more than one year, custody, or supervised release, if the person:
Shuts down or destroys the monitoring, alarm, protective, or life-saving equipment or facilities that directly affect production safety, or tampers with, conceals, or destroys their relevant data and information;
Refuses to suspend production, operation, construction, or use of relevant equipment, facilities, or places or take immediate corrective measures to eliminate hazards as ordered in accordance with the law due to the existence of major accident risks; or
Engages in mining, metal smelting, construction, or the production, operation, or storage of hazardous materials or other highly hazardous production or operation activities without approval or permission in accordance with the law.
