Article 79 [Procedure for Commutation] For the commutation of an offender, the executing authority shall submit a proposal for commutation to the competent intermediate or higher people's court.
The people's court that receives a proposal for commutation shall appoint a collegial tribunal to hear the case, and make an order to grant a commutation if it is ascertained that the offender has shown genuine remorse or performed meritorious service.
No commutation may be granted without legal procedures.
