Article 147 [Producing or Selling Counterfeit or Inferior Pesticides, Veterinary Drugs, Fertilizers or Seeds] A person who produces counterfeit pesticides, veterinary drugs, or fertilizers, or knowingly sells pesticides, veterinary drugs, fertilizers, or seeds that are counterfeit or have lost their use efficiency, or produces or sells non-conforming pesticides, veterinary drugs, fertilizers, or seeds alleging that they are conforming, shall be sentenced to imprisonment of not more than three years or custody and/or a fine of not less than fifty percent of but not more than two times the sales amount if major losses to production are caused thereby, or to imprisonment of not less than three years but not more than seven years and a fine of not less than fifty percent of but not more than two times the sales amount if significant losses to production are caused thereby, or to imprisonment of not less than seven years or life imprisonment and a fine of not less than fifty percent of but not more than two times the sales amount or forfeiture of property if particularly significant losses to production are caused thereby.
