Article 163 [Non-Public Official Taking Bribes] An employee of a company, enterprise, or other entity who, by taking advantage of their positions, solicits or illegally accepts property or other benefits from others to seek benefits for them shall be sentenced to imprisonment of not more than three years or custody and a fine if the amount is large, or to imprisonment of not less than three years but not more than ten years and a fine if the amount is significant or the offense is committed under other serious circumstances, or to imprisonment of not less than ten years or life imprisonment and a fine if the amount is particularly significant or the offense is committed under other particularly serious circumstances.
An employee of a company, enterprise, or other entity who, taking advantage of their positions in economic transactions, accepts rebates and service fees under various disguises in violation of national ordinances as their personal property shall be punished in accordance with the provisions of the preceding paragraph.
A public official of a State-owned company or enterprise or other State-owned entity or a public official dispatched by a State-owned company or enterprise or other State-owned entity to a non-State-owned company, enterprise or other entity who commits any of the acts stipulated in the preceding two paragraphs shall be convicted and punished in accordance with the provisions of Article 385 or 386 of this Law.
