According to Article 218 of the Penal Law of the People’s Republic of China, a person knowingly sells infringing works and has obtained profits in an aggregate amount of RMB 100,000 (included) shall be sentenced to imprisonment for a term of which the maximum is three years, or detention, and a fine in addition or alone.
According to the Penal law, the maximum length of detention shall not be less than one month or more than six months.
And the amount of the said fine, according to the applicable Interpretations, shall not be less than fifty percent or more than five times of the illegal proceeds from the sales.
In order to be granted probation or exemption from imprisonment or detention, the actor may make a confession of his crime before the investigation procedure is initiated.
